Twenty Years for Marijuana GrowerFor twenty years, David Companioni of New York will be in state prison on a marijuana distribution and production conviction. Companioni, age 32 was sentenced last month for his large-scale marijuana production facility operating out of Newark, New Jersey.

The Charges: The 20-year sentence for Mr. Companioni follows a conviction last August by the Essex County Superior Court on the charges below:

Additional Parties: Along with Mr. Companioni, a second NJ man was also convicted in the case. Aday Y. Fernandez, age 34, and is scheduled for sentencing in mid-November. In April, he pleaded guilty to conspiracy charges, as well as charges of maintaining or operating a controlled dangerous substance production facility. State attorneys recommend that he receives a seven year sentence in state prison, far lower than the 20 years assigned to Companioni.

Initial Arrest: Both Companioni and Fernandez were arrested back in February 2012 following the discovery by NJ State Police Drug Trafficking Unit of over 100 marijuana plants in a large warehouse on Miller Street, Newark, as well as a personal home of several families on Summer Avenue. Following that arrest, the investigation continued with a separate warrant to the home of Fernandez in West New York. At his residence, they seized over $42,000 in cash along with pounds of marijuana for distribution.

As evidenced in this case and many others, there are serious consequences for those who are convicted of criminal drug charges in the state of New Jersey, especially those who have been charged with distribution and production on top of possession. Penalties for all drug charges in New Jersey carry hefty fines, a criminal record, the mandatory loss of driver’s license (even if an automobile was not involved in the case specifics), and possible jail time.

With extensive experience in successful investigations and plea deals, I am highly qualified to best represent your case and provide you with the greatest possible outcome in eliminating penalties. When I review the evidence in a case I’m handling, I look for any unconstitutional proceedings that may have been carried out by the police while investigating your case. I will request a certified laboratory report from the state of New Jersey to determine if the case against you was properly handled. If it was, I will work to strike a plea deal that will protect your rights and minimize the lasting impact that a conviction will have on your future.  Often I am able to prevent my clients from getting a criminal record, and I am also able to save driving privileges on many occasions.
