Nobody likes to be “ripped off” on a purchase.  If you have recently made a purchase and feel like you did not receive what you bargained for, you may be right and might have a possible claim to recover some or all of your money back.  New Jersey has a very “friendly” Consumer Law Statue, which gives great protections and rights to anybody who makes a purchase in New Jersey.

Often as a consumer, you may be a victim and have a cause of action and not even be aware of what your rights are.  New Jersey Statute 56:8-2 provides protection from any purchase made through misrepresentation, deception, fraud, purposeful omission, concealment, or suppression of any material fact regarding the transaction.  This is as a strict liability standard, so even if they seller did not intend to mislead you it does not matter, and you still have rights.

Under this Statute, a consumer might be entitled to treble (triple) damages and attorney fees, so often once an attorney is involved there is a good chance for a quick settlement for the fair amount owed to you.

The most common times I see consumer fraud issues is on purchasing or leasing a vehicle, funeral expenses, health clubs memberships, moving companies, repairs, warranties, and home contractors.  However, ANY PURCHASE can qualify under this statute.   If you were told something before your purchase that turns out not to be true, or promised something that was not done, you have rights in New Jersey and should not feel like you should just throw the towel in and walk away from your hard earned money.

It may seem as if when dealing with this fraud that seeking help and remedies can be challenging and difficult to maneuver through the process. Do not let this dissuade you from having protection under the act!
